ANALYSIS OF THE REGULATORY LEGAL ACTS OF THE EUROPEAN UNION ON DIGITAL (SMART) TACHOGRAPHS AND PROPOSALS FOR UPDATING THE NATIONAL LEGISLATION OF UKRAINE

Abstract. In the context of European integration, Ukraine has committed to harmonizing its national legislation with that of the European Union, including in the field of road transport. A critical component of this process is the implementation of modern technologies aimed at improving road safety, enforcing drivers’ working and rest time regulations, and ensuring fair competition in the transportation market. One such measure involves the introduction of SMART tachographs, as mandated by EU Regulation No. 165/2014. This regulation sets out technical and functional requirements for the installation, operation, and maintenance of tachographs to enhance transparency, data protection, and enforcement efficiency.
Despite significant progress, Ukraine’s current legal framework still lacks consistency with key EU definitions and standards, particularly regarding terminology. This article assesses EU legal instruments governing tachograph systems, analyzes the current state of Ukrainian legislation, and outlines necessary amendments to align national laws with EU norms. It identifies gaps in the harmonization of terminology, such as the absence of clear distinctions between analog, digital, and SMART tachographs in Ukrainian legal texts.
The study highlights the benefits of implementing EU standards, including improved road safety, fraud prevention, and the integration of Ukraine’s transport system into the Trans-European Transport Network (TEN-T). It proposes developing a unified glossary of terms and amending core legal acts, including the Law of Ukraine “On Motor Transport” and related administrative regulations, to ensure precise and standardized terminology across the sector.
Harmonizing legal definitions and enforcing SMART tachograph standards will enhance Ukraine’s compliance with EU obligations, foster investment in the transport sector, and strengthen the country’s position in the international transport market.
